Can a person marry or have a marriage contract concluded while in ihram?

No. 'Uthman ibn 'Affan reported that the Prophet (ﷺ) said, "The one in ihram may not marry, nor give in marriage, nor propose" (Sahih Muslim 1409), so a person in ihram may neither contract a marriage for himself nor act as guardian or agent for another. The majority (Malikis, Shafi'is and Hanbalis) hold that such a contract is invalid and must be concluded afresh after coming out of ihram. The Hanafis permit it, relying on Ibn 'Abbas's report that the Prophet (ﷺ) married Maymunah while in ihram (Sahih al-Bukhari 1837; Sahih Muslim 1410). The majority answer that Maymunah herself said he married her while they were both free of ihram (Sahih Muslim 1411), and she was the one best placed to know her own marriage, so the explicit prohibition narrated from 'Uthman takes precedence — especially as it is a statement of general law rather than a report about one incident. Sexual relations and intimacy are in any case forbidden outright in ihram, as Allah says, "whoever has made Hajj obligatory upon himself therein, there is no rafath..." (Quran 2:197).
